In Colorado, there are three main types of state criminal offenses – felony charges, misdemeanor charges and municipal violations. Felony offenses are considered more serious, and could lead to a prison sentence and parole, but all criminal charges come with the possibility of incarceration, probation, and a permanent criminal record.

Common felony charges include first and second-degree assault, vehicular homicide and vehicular assault, sexual assault, burglary, and possession of a controlled substance. Felony offenses are charged with a felony complaint in district court, prosecuted by the County District Attorney’s Office, and presided over by a district court judge for the county where the offense occurred. These cases could result in a period of incarceration in the state prison.

A misdemeanor charge, include offenses like third-degree assault, child abuse, and Driving Under the Influence. These kinds of cases are brought by way of a summons or warrantless arrest affidavit in county court and presided over by a county court judge. These cases can result in a jail sentence that would be served in the county jail.

While municipal violations are not considered to be serious, most municipal prosecutors are tough and the sentences widely vary in municipal courts depending on the town or city the case is pending in. These are violation of city municipal ordinances and can result in a shorter jail sentence.
